Official "HOOPS FRENZY" Rules
GENERAL RELEASE:
By entering the "Hoops Frenzy" contest, entrants release <CLIENT>, and each of their respective affiliated companies, subsidiaries, advertising or promotional agencies, and other agents, and any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in conjunction with the "Hoops Frenzy" contest or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages elated to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

This contest is not associated with, or sponsored by the National Collegiate Athletic Association (NCAA); any accredited college, university or institution of higher education; any athletic conference or organization or have any affiliation in any way with any sports organizations or athletes.

PARTICIPATION:
By participating, entrants agree to be bound by these Official Rules and the decisions of the judges. <CLIENT> reserves the right to disqualify persons determined to be tampering with or abusing any aspect of the contest, as solely determined by <CLIENT>. In the event the contest is compromised by a virus, non-authorized human intervention, tampering, or other causes beyond the control of the <CLIENT> which corrupts or impairs the administration, security, fairness or proper operation of the contest, <CLIENT> reserves the right in its sole discretion to suspend, modify or terminate the contest.

Should the contest be terminated prior to the stated expiration date, <CLIENT> reserves the right to award prizes based on the entries received before the termination date.

ELIGIBILITY:
The "Hoops Frenzy" contest is open to U.S. Residents, (excluding Puerto Rico), 18 years or older at the time of entry. Employees of <CLIENT>, each of their respective affiliated subsidiaries, companies or agencies and the immediate family members of, and any persons domiciled with such employees, are not eligible.

CONTEST RULES:

  •  No purchase necessary. Federal, state, local and municipal laws and regulations apply. Void where prohibited.
  • <CLIENT> and <SPONSOR> will not be responsible for incomplete, lost, or late entries or for the failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with the sender or <SPONSOR>. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the email account from which they were sent. The <SPONSOR> reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the "Hoops Frenzy" contest.
  • By entering, each entrant accepts and agrees to the "Hoops Frenzy" contest rules.
  • Any entrant who attempts to enter with multiple e-mail addresses or under multiple identities, or uses any other device to enter multiple times will be disqualified. Any entrant who participates using a nickname deemed inappropriate by <CLIENT> will be automatically disqualified.
  • Winner agrees to the use of his/her name and likeness without any additional compensation by sponsors for publicity. By entering this contest, the winner acknowledges that <CLIENT> and all other <SPONSOR> and venues have the right to publicize his/her name, voice, likeness, the fact that he/she won, and all matters incidental thereto.
  • In the event of a dispute, the decision made by <CLIENT>, is final and binding.

    PRIZES AND ODDS:

    • Winner will receive: <PRIZE DESCRIPTION>.
    • Odds of winning depend on the number of eligible entries received and the number of correct picks.
    • Winner will be notified by email at the conclusion of the "Hoops Frenzy" contest, on or about April 10, 2003. Return of prize notification as undeliverable or failure to respond by winner may result in disqualification and an alternate winner may be selected.
    • Winner may waive his/her right to receive prize. Prize is non-transferable and non-assignable and may not be exchanged for cash. No substitution of the prize is allowed, except that prize and individual components of prize package are subject to availability, and <SPONSOR> reserves right to substitute prizes of equal or greater value. Winner is solely responsible for reporting and payment of any taxes on prizes.
    • Winner may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of the postmark. Failure to sign and return affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, will result in a winner’s disqualification, the forfeiture of his/her interest in the prize, and the award of prize to an alternate winner.
    • Winner agrees to the use of his/her name and likeness without any additional compensation, by the sponsors for publicity, by entering this contest. The winner acknowledges that the <CLIENT>, and all other sponsors and venues have the right to publicize his/her name, voice and likeness, the fact that he/she won.
    • Driver’s license or other appropriate picture identification is required to claim the prize. Winner may be required to execute and return an affidavit of eligibility and a release.
    • For prize winners’ list (available after April 10, 2003), send a self-addressed, stamped envelope to: the "Hoops Frenzy" contest <CLIENT>, <CLIENT ADDRESS>
    • Winners will be selected from all eligible entries at the conclusion of the "Hoops Frenzy" contest, on April 10, 2003, based on the highest point total accumulated throughout the Contest Period. In the event of a tie, the winners will be chosen in a random drawing from those tied entries with the highest point totals. One grand prize winner will receive <PRIZE DETAIL>. One runner up will receive <PRIZE DETAIL>.

      SPONSOR:
      The "Hoops Frenzy" contest is sponsored by <SPONSOR>, whose decisions regarding the selection of winners and all other aspects of the contest shall be final and binding in all respects. <SPONSOR> will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials, in print or electronic format, relating to this contest.

      HOW TO PLAY:
      Limit one entry per person. New participants will complete a brief user registration profile.

      The object of the "Hoops Frenzy" contest is to collect the most number of points by picking the most winning teams. If you have the most number of points, you win.

      • One point will be given to all correct choices in the first round games. (32 games X 1 point = 32 possible points)
      • Two points will be given to all correct choices in the second round games. (16 games X 2 points = 32 possible points)
      • Four points will be given to all correct choices in the third round games. (8 games X 4 points = 32 possible points)
      • Eight points will be given to all correct choices in the fourth round games. (4 games X 8 points = 32 possible points)
      • Sixteen points will be given to all correct choices in the semifinal games. (2 games X 16 points = 32 possible points)
      • Thirty-two points will be awarded for selecting the winner of the Championship game. (1 game X 32 points = 32 possible points)
      • There are 192 possible points in the contest.
      • You will receive 2 points in your overall scores for each NEW user that participates in "Hoops Frenzy".

      The winner of the Grand Prize will be awarded to the player with the highest combined point total. In the event of a tie, a Grand Prize winner will be chosen by random drawing conducted by <CLIENT>.

      FAIR USE/ABUSE POLICY:
      <CLIENT> and sponsoring parties to "Hoops Frenzy" reserves the right to adjust the scoring and rankings because of unfair or unsportsmanlike conduct or abuse. This includes but is not limited to:

      • Setting up false accounts to increase point values
      • Over use of additional feature sets to increase point values
